James Lindsay, the driver who allegedly ran off the road in Bowling Green on Saturday and killed a bicyclist on a sidewalk, was indicted Thursday by the Wood County Grand Jury on four charges.
Lindsay, 54, Dunbridge was indicted for aggravated vehicular homicide, a felony of the first degree; operating a vehicle under the influence of alcohol or drugs, an unclassified misdemeanor; and two charges of attempting to leave the accident scene, a felony of the third degree and of the fourth degree.
Lindsay is charged with driving off the roadway and striking a bicyclist near the intersection of South Main Street and Pearl Street. Michael Szabo, 60, was pronounced deceased at the scene.
Officers on the scene had Lindsay perform field sobriety tests, then asked the driver to do a breath test, which he refused to do, reported BGPD Lt. Adam Skaff.
According to the police report, there was an open alcoholic beverage in the truck. A search warrant was granted for a blood test.
Multiple witnesses reported to police that Lindsay tried to drive away from the crash scene, but was unable to move the truck.
Lindsay was reportedly driving with a suspended driver’s license at the time of the fatal crash. Sandusky County Common Pleas Court records show he was charged on June 5, 2023, with OVI, with OVI within 20 years of previously having been convicted of or pleaded guilty to OVI, driving with an open container of beer or liquor, and endangering children in his vehicle.
Bowling Green Municipal Court records show Lindsay was charged on March 6, 2016, with OVI with a BAC of 0.17.
