Wood County Recorder Connor Rose is alerting homeowners who signed long-term agreements with MV Realty of Ohio, LLC that a one-time cancellation opportunity is available.
The agreements, called Homeowner Benefit Agreements (HBAs), gave MV Realty exclusive listing rights for up to 40 years and included a memorandum recorded with the county recorder’s office. Many homeowners may not have realized the long-term nature and implications of these contracts.
Homeowners who qualify can cancel their agreements without repaying the upfront incentive money they received from MV Realty. A one-time $75 fee will apply. All cancellations must be submitted to MV Realty by Wednesday, April 29. Once processed, MV Realty is then required to record a termination document with the recorder’s office, releasing the memorandum from public record.
“This is a one-time opportunity for affected homeowners,” Rose said. “Residents should review their property records and act quickly if they think they qualify. Where applicable, our office, along with the Ohio Attorney General, is providing informational notice to property owners whose recorded documents may be affected.”
The cancellation process stems from an investigation and resolution between MV Realty and the Ohio Attorney General’s Office. In October 2023, Ohio enacted R.C. 5301.94, which identifies certain exclusive residential listing practices as unfair or deceptive and in violation of the Ohio Consumer Sales Practices Act, R.C. 1245.01. While agreements signed before the law were not automatically voided, the Attorney General negotiated this cancellation window with MV Realty to give affected homeowners a chance to terminate their contracts.
Homeowners can check property records through the Wood County Recorder’s online search tool or by visiting the recorder’s office.
