The Perrysburg teenager charged with aggravated murder in the death of Amonie Ervin, 19, appeared in Wood County Juvenile Court today, according to Wood County Prosecuting Attorney Paul Dobson.
Tyler Miller, 16, through his attorney, waived his right to have a probable cause hearing, where prosecutors would have been required to put evidence before the court regarding Miller’s involvement in the crime.
For Miller’s age, aggravated murder is considered an “automatic bindover” charge, meaning that once the juvenile court determines there is probable cause, it must send the case to the Wood County Common Pleas Court for the juvenile to be prosecuted as an adult.
Based on the waiver, Wood County Juvenile Judge David Woessner bound Miller over to the Wood County grand jury and the adult criminal justice system.
Ervin was pronounced dead at the scene of the stabbing on Nov. 29 on Tonbridge Court in Perrysburg. Ervin reportedly suffered 20-25 incised wounds and stab wounds to his head, face, neck, chest, both arms and both hands.
Also at the hearing, the court ordered that Miller be held at the Wood County Justice Center pending trial, based on concerns prosecutors had raised as to his being a potential threat to others in the juvenile detention center. By law, Miller will be held separated from any adults in the jail.
Dobson said he anticipates the case will be presented to the grand jury before the end of the year.
