Grand Rapids brewery to appeal liquor commission finding

A Grand Rapids brewer plans to appeal a state finding that he violated Ohio’s health and safety regulations.

On Oct. 14 Wild Side Brewing was cited for allowing the consumption of beer between the hours of 11 p.m. and 5:30 a.m. in violation of “limitation of hours for on-premises sales and consumption” in state administrative code.

Owner Nicholas Scott said at the time the establishment was closed and he and two bartenders were cleaning up when two agents knocked on the locked door. When he opened to tell them the bar was closed they flashed badges and entered. They found a half glass of beer that Scott was consuming while working. No customers had been in the bar since 10:30 a.m.

The Ohio Liquor Control Commission reported that at the hearing, a denial was entered on behalf of the permit holder. Based on the evidence presented, the Commission found the permit holder in violation. The Commission issued a three-day suspension beginning at noon, March 22, but gave the permit holder the option to pay a financial forfeiture in the amount of $300 in lieu of serving the suspension.

Scott said he will appeal.

Also during the February hearings, Westwood Endeavors at 13217 Main St. was also found in violation of serving on-premises between 11 p.m. and 5:30 a.m. on or about Sept. 18.

The permit holders also denied the charge, but were found in violation. The Commission issued a five-day suspension beginning at noon, March 22, but gave the permit holder the option to pay a financial forfeiture in the amount of $500 in lieu of serving the suspension.
